Terms & Conditions

 

These terms and conditions must be signed as a declaration of agreement by the hirer and Border Escapes Limited on the hire start date.

 

1. Your contract with us  

1.1. When you sign the rental agreement, you accept the conditions set out in this rental agreement. 

1.2. Please read this agreement carefully - you will be required to sign to confirm agreement. 

1.3. If there is anything you do not understand please ask for a further explanation. 

2. Rental period 

2.1. You will have the vehicle for the period shown in this agreement. 

2.2. If you break our agreement, we can ask you to bring the vehicle back before the date and time we have agreed with you. 

2.3. To do this we will give you written notice via the email address you have provided, a hard copy will be sent to your home address and you will be phoned. 

2.4. Once we have given you notice, you no longer have our permission to have the vehicle. 

2.5. We may then take back our vehicle. If we believe you have given us false information, we may take back our vehicle without any notice. 

3. Your responsibilities 

3.1. You must inspect the vehicle and any accessories we provide before you take the vehicle. 

3.2. If you are not satisfied with the vehicle or you do not think the condition of the vehicle meets our pre rental standard as per inspection report, you must let us know. 

3.3. You must look after the vehicle, any accessories and the keys or other locking device of the vehicle. 

3.4. You must always lock the vehicle when you are not using it and use any security device that is fitted or that we have supplied. 

3.5. You must always protect the vehicle against weather conditions which could cause damage. 

3.6. You must make sure you use the correct type of fluid and fuel in the vehicle. 

3.7. You are responsible for any damage to the vehicle, including damage to under carriage, overhead damage (above 6ft in height) caused by but not limited to hitting low level objects such as bridges, low hanging tree branches or barriers along with damage to the awnings or frozen pipework whilst the vehicle is on hire to you. 

3.8. You will have to pay our reasonable costs for bring the vehicle back to the condition stated in the pre rental inspection report. 

3.9. This could include but not limited to any damage inside and outside the vehicle, cleaning costs if the vehicle is very dirty, and replacing any items or accessories. 

3.10. You must not sell, rent or get rid of the vehicle or any of its parts. 

3.11. You must not give or try to give anyone the legal rights to the vehicle or transfer legal ownership. 

3.12. You must not let anyone work on the vehicle without our permission. If we do give you permission, we will only give you a refund if you have a receipt for the work carried out that we have given permission for. 

3.13. You must let us know as soon as you become aware of a fault on the vehicle, or if the vehicle is stolen or involved in a collision. 

3.14. If we have agreed to drop off the vehicle at an address you have given us, you will be responsible for the vehicle from the time we drop it off. 

3.15. Unless we have agreed to collect the vehicle from you, you must return the vehicle to the location we agreed. You must return it during opening hours or at a time we have agreed. When you return the vehicle, a Border Escapes Partner will check its condition. If we have agreed to you returning the vehicle outside of our opening hours, then you will be responsible for the vehicle until it has been checked by a member of staff. We may need to clean the vehicle to check its condition. 

3.16. You may not carry any object or substance which because of its condition or smell, may harm the vehicle or cause us delay in renting or selling the vehicle. 

3.17. You are responsible for all damage whatsoever caused by misuse or negligence and for all tyre repairs or replacement, wing mirrors, and for broken windows and lights and for any damage to the awning or frozen pipework. 

3.18. You are responsible for checking the engine oil, water levels and tyre pressure at least once a week during your hire. 

3.19. The vehicle is supplied with a bottle of LPG, Subsequent refills are your responsibility. You must ensure that refilled bottles are of the same size and fitting. Only “Calor” branded bottles are to be used. 

3.20. You are responsible for all/any damage to the awning of the vehicle. 

3.21. You are responsible for any frozen pipework which occurs whilst the vehicle is on hire to you. 

3.22. You must return the vehicle with the same amount of fuel in it that was in it at the start of your rental period. 

4. Our Responsibilities 

4.1. We will identify and tell you about any existing damage to the vehicle before you sign your acceptance form. 

4.2. The vehicle will be roadworthy and suitable for use at the start of the rental period. 

4.3. We accept no responsibility for delays and/or consequential losses from breakdown or from any other circumstance. 

5. Property 

5.1. We are only responsible for loss or damage to property in the vehicle if the loss or damage is as a result of our neglect or if we have broken the conditions of the agreement. 

5.2. You are responsible for removing your personal belongings from the vehicle at the end of your rental period, as we are not responsible for any items you leave in the vehicle. If you do leave items in the vehicle, we may agree to keep them for you to collect within a reasonable time. We may charge you reasonable costs for storage. 

5.3. We recommend you take out personal travel and cancellation insurance. 

6. Availability 

6.1. Occasionally motorhomes are not available as agreed, which is almost always due to events beyond our control. 

6.2. If your booking has to be cancelled (which we have the right to do) we will offer you a choice of alternative date.

6.3. If no suitable replacement date is available, we will provide you with a full refund of all monies paid for the booking. 

6.4. Availability is on a request and confirm basis at the time of reservation. It is only binding after it has been confirmed with a non-refundable deposit has been received. 

6.5. Settlement of the balance will be due no later than 14 days prior to commencement of your rental period. We reserve the right to cancel any bookings if full payment hasn’t been received by this time. Full payment will be required for any bookings taken within 14 days of rental date. 

7. Events beyond the operator’s control 

7.1. Unfortunately, events beyond our control may occasionally affect bookings. When reference is made to such events, this means any events or circumstances which the motorhome operator could not, even with all due care could not foresee or avoid. 

7.2. When such an event occurs, we cannot accept responsibility or pay any compensation, costs or expenses where the performance of your agreement with us is prevented or affected or you otherwise suffer any loss or damage as a result. 

7.3. This includes delays to and/or restrictions to your hire. 

7.4. During hot weather, fridges and freezers in motorhomes do not always perform as expected which is beyond our control. We will not accept any responsibility for any loss of food or beverages and no compensation will be issued. 

8. Conditions for using the vehicle 

8.1. Only drivers named on the rental agreement can drive the vehicle. 

8.2. Anyone driving the vehicle must be over 30 – 75 years of age and have a full driving license which is valid in the European Economic Area for the type of vehicle you are renting. 

8.3. You must not rent the vehicle to anyone else. 

  1. 8.4. You also must not use the vehicle or allow anyone else to use it for the following: 
  2. a) For any illegal purposes or in any way that would cause nuisance 
  3. b) To carry passengers for a fee 
  4. c) For driving lessons 
  5. d) To tow or push any vehicle, trailer or other object. 
  6. e) For racing, pacemaking, or to test the vehicles’ reliability or speed. 
  7. f) Off Road or on roads unsuitable for the vehicle. 
  8. g) If the driver has been taking drugs or drinking alcohol. 
  9. h) Outside the UK, unless we have given you written permission and a vehicle on hire certificate. 
  10. i) If it’s loaded beyond the manufacturers maximum weight recommendations 
  11. j) To carry unsecured loads. 
  12. k) To carry more passengers than the vehicle was manufactured to carry 
  13. l) If the driver does not have a valid operator’s licence. 

9. Charges 

9.1. We work out the charges using our current price list. 

9.2. You are responsible for all charges even if you have asked someone else to be responsible for them. 

  1. 9.3. You will be responsible for paying the following charges: a) The rental and any other charges we work out according to this agreement. 
  2. b) Any charges for loss or damage resulting from you not keeping to your responsibilities (see section 3) 
  3. c) A refuelling service charge if you did not return the vehicle with agreed amount of fuel. The charge will be £50 per ¼ tank. 
  4. d) A cleaning fee of £100, if the vehicle is not returned with the interior in a clean condition. 
  5. e) A fee of £100 will be applied if the toilet cassette is not returned emptied and its surrounding area is in a clean condition. 
  6. f) A fee of £50 for any/all the water tanks requiring emptying on return. 
  7. g) All charges and costs relating to damage to the windscreen, wing mirrors, tyres (including punctures or replacements.), overhead damage (above 6ft in height) and the under carriage of the vehicle. 
  8. h) All charges and legal costs for any congestion charge, road traffic offence or parking charges or any other offence involving the rental vehicle, including costs from the vehicle being clamped, seized or towed away. You are responsible for paying the appropriate authority or company for any charges and costs if and when they ask for payments. You will also be responsible for paying our administration charge of £25 for dealing with these matters. 
  9. i) The reasonable cost of repairing any damage to the vehicle, which was not noted on the start of the agreement, whether you were at faulty or not. You will also be responsible for paying the reasonable cost of replacing the vehicle of it is stolen or written off, depending on any insurance you have, if and when we demand this payment. 
  10. j) An administration charge of £75 will be payable with all repair/replacement invoices. 
  11. k) If you do not return the vehicle at the agreed time, a late return charge of £100 per hour will be applied. 
  12. l) Any recovery charges arising from the Driver and Vehicle Standards agency (DVSA), HMRC, the Police or any other public organisation (or their agent) who has seized the vehicle. 
  13. m) Any published rates for delivering or collecting the vehicle, a charge for an extra driver or returning the vehicle late, and charges for accessories such as child car seats satellite navigation systems and other similar items. 
  14. n) Any breakdown call-out charges not relating to electrical or mechanical issues. 

10. Our Motor Insurance 

10.1. You can get full details of our motor insurance anytime. 

10.2. Conditions of the insurance will apply at all times. 

10.3. By signing these Terms and Conditions, you are accepting the conditions of our motor insurance, 

         An excess of £750 applies. 

10.4 Our motorhome has full comprehensive insurance for damage to our motorhome. Only drivers named on 

        the rental agreement are insured to drive.

11. Your own Motor Insurance 

11.1. Does not cover you for using this vehicle.

12. What to do if you have an accident 

12.1. If you are involved in an accident, you must not admit you are at fault. 

12.2. You should describe the situation as fully as possible when you are asked to do so by the police and us. 

12.3. You should get the names and addresses of everyone involved, including witnesses (using the form provided) 

12.4. You should also: 

  1. a) Make sure the vehicle is secure. 
  2. b) Tell the police straight away if anyone is injured or if there is a disagreement who is at fault. 
  3. c) Contact us straight away and send us a photo of the accident form and then send us the hard copy to the address shown on the rental agreement form. 

13. What to do if the vehicle is stolen 

13.1. If the vehicle is stolen, you must contact us as soon as possible and confirm this in writing as soon as possible. 

13.2. You must also contact the police as soon as possible. 

13.3. You will also need to get names and addresses of any witnesses and forward them to us. 

13.4. You must send us any notices or other legal documents relating to any legal proceedings arising out of theft or loss. 

13.5. Help us in any legal proceedings and give back all keys to the vehicle. 

14. Data Protection 

14.1. By entering into this rental agreement, you agree that we can process and store your personal information in connection with this agreement. 

14.2. We will use your information to analyse statistics, for market research, credit control and to protect our assets. 

14.3. You agree that if you break the terms of this agreement, we can pass on your personal information to credit reference agencies, debt collectors, the Police or any other relevant organisation. 

14.4. We can also give this information to British Vehicle Rentals and Leasing Association (BVRLA), which can share your personal information with its members to prevent crime and protect its assets, as allowed under the Data Protection Act 1998, as revised. 

15. Ending this agreement 

15.1. We will end this agreement if we find out that you’ve given us false details, or you don’t meet the conditions of this agreement. 

15.2. If we do end this agreement, it will not affect our right to receive any amount you owe us under the conditions of this agreement. 

15.3. We can also claim reasonable cost from you if you do not meet the conditions of this agreement. 

15.4. We can repossess the vehicle and charge you a reasonable amount for doing so. 

16. The Law 

16.1. We aim to deal with all disagreements fairly and calmly. If we cannot deal with a disagreement, we may take the matter to the BVRLA’S conciliation service. 

16.2. This agreement is governed by the laws of the country in which you signed it. 

16.3. Any disagreements may be settled in the courts of that country. 

16.4. This agreement contains all the conditions which we have agreed and replaces any written or verbal agreements we have with you.
